Representatives of the Department Attended the Presentation of the Draft Law of Ukraine “On Patents and Utility Models”

On October 7, 2026, a presentation of the Draft Law of Ukraine “On Patents and Utility Models” was held at the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO). The event was attended by Ye. V. Lytvynenko, PhD in Law, Senior Lecturer; K. D. Yanishevska, PhD in Law, Associate Professor; O. P. Klipa, PhD in Law, Senior Lecturer; alongside Master’s degree candidates enrolled in the “Intellectual Property” educational program.

The primary objective of the event was to deliberate on the legislative amendments required to fulfill Ukraine’s intellectual property obligations in its pursuit of European Union membership. Furthermore, these regulatory adaptations are an essential prerequisite for Ukraine’s accession to the European Patent Convention (EPC).

The attendees engaged in a comprehensive discussion of the core provisions of the draft legislation, encompassing:

  • the implementation of the European model of invention protection: patents and utility models;

  • regulatory frameworks facilitating Ukraine’s accession to the EPC;

  • the structuring of patentability criteria, aligning with EPC methodologies, and stipulations regarding the protection of biotechnological inventions;

  • a fundamental reform of the legal regime governing utility models;

  • the clarification of provisions pertaining to biotechnological inventions (including supplementary farmers’ privileges, compulsory cross-licensing, and the deposition of biological material);

  • the optimization of the patent granting procedure, which covers registration, the issuance of patent certificates, as well as publication fees and state duties;

  • legal norms recognizing patents and patent applications as objects of property rights.

Participation in this event provided academic staff and degree candidates with a firsthand understanding of the forthcoming transformations in patent legislation. Furthermore, the acquired insights will be instrumental in systematically integrating these legislative advancements into the pedagogical process and scientific research within the “Intellectual Property” educational program.
